Query does NOT refresh if there are no existing records

I have a query on a vp with no records. I have a panel operation button to create a record, which will open a popup form, and allow the user to create a new record. After it is saved, there is NO refresh. The record is NOT displayed in the query. However, if there is an existing record, and I do the same thing, to add a shiny new record, then the Auto refresh works fine.

Have you set the refresh conditions on the Query as well as the panel?

i had this behavior over a month ago.
exactly as you describe.
only happens the first time - after that 1st rec is created.
after that, looks normal.
was latest V8 at the time

Yes, I have auto-refresh on the query. (If the panel is displaying a query there is NO option for autorefresh in the panel cell).

and I can easily duplicate this. Tom and Mark, you are telling me you do NOT have this issue when you have a BO with no records? Humm, why am I getting this then?

Sorry about that Bruce. With grandchildren swirling around, my first BSV totally ignored your issue.

This one works to refresh the query when adding the first instance by either a menu option or a process:
